Licence agreement

The software is protected under the English Copyright Acts and International Copyright Conventions. All rights are reserved by McKenzie Electronics. Copying, duplicating, selling or otherwise distributing any part of this product without prior written permission of an authorised representative of McKenzie Electronics is prohibited.

McKenzie Electronics grants you a non-exclusive, non-transferrable license to use The Software on one installation at one site only. You may install the Program onto the hard disk of one computer (and a backup computer at the same location). You may also make one copy of the Program disk for backup purposes. These copies must include the McKenzie Electronics copyright notice.

The Mixer Control Program including its related documentation is copyrighted. You may not: rent, distribute or transfer copies of the Program or documentation to others; modify, reverse engineer, disassemble, decompile, or translate the Program or documentation; use the Program on more than one console, on a multi-user computer, on a time-sharing system, on a service bureau, or any other system on which the Program could be used by more than person at a time.

This license is effective until terminated. You may terminate it at any time by destroying all copies of the Program. It will also terminate automatically if you fail to comply with any of the terms and conditions of this Agreement.

This Agreement constitutes the entire agreement and understanding between the parties and supersedes any prior agreements, representations or understandings, whether oral or written, relating to The Software.

Limited Warranty

McKenzie Electronics warrants that the material of any supplied Software Disk and Manual are not defective. The Programs have been properly recorded on to the disk. The Programs function substantially as described in the manual.

Changes in specification and design

The specification and design of this product may be subject to change. McKenzie Electronics reserve the right to make such changes at any time without notice.

Defects in manufacture and materials

McKenzie Electronics do not accept any liability whether in contract tort or otherwise as to the quality of its product or its performance nor in respect of the installation or suitability of the product save insofar as that in the event of a defect in the manufacture or of the materials of the product then McKenzie Electronics may at its own option either reimburse to the purchaser the basic cost of the product not including installation or other additional costs or replace the product at its own cost. This is provided that it has been notified in writing within 14 days.

Consequential loss

McKenzie Electronics does not guarantee or assume any liability in respect of any consequential loss whether direct or indirect arising out of failure in the product whether by reason of a defect in the manufacture or materials of the product negligence or otherwise. McKenzie Electronics does not warrant or make any representation and assumes no liability in tort or otherwise in respect of the product or any part of it regarding the use of the Programs in terms of correctness accuracy reliability currency or otherwise.

Instructions for use

Instructions for use are designed for users knowledgeable in computer operation. No liability whether in tort or contract is accepted by McKenzie Electronics for any loss of any nature based on any claim as to the adequacy or otherwise of the instructions for use.
